Before You Hire

Legal-There may be other requirements based on your business classification.  For information on occupational and professional licensing call the Business Standards Division at: (406) 841-2300.

To register a business name call the Montana Secretary of State at: (406) 444-3665 or go to: http://sos.mt.gov/Business/Startup/index.asp 

1 – 4 Need to be done before an employee is hired

1. Federal Employer Identification Number - Social Security & Federal Income Tax Withholdings

  • Required if you have employees
  • Forms are available by calling 1-800-829-1040 or at: www.irs.gov

 2. Unemployment Insurance

  • Call the Unemployment Insurance Division at (406) 444-3834 to receive a packet by mail or go to: http://www.uid.dli.mt.gov/tax/uitaxforms.asp
  • Complete and submit registration forms
  • Ask them to send you a letter stating your employees are covered by Unemployment Insurance (posting requirement) 
  • State Income Tax Withholdings
  • Call the Department of Revenue at (406) 444-6900 to receive a registration form by mail or go to: www.revenue.mt.gov/
  • Complete and submit registration forms

3. Workers Compensation Insurance

  • Must have coverage on employees before they start employment
  • Ask your insurance carrier for a letter stating all your employees are covered by Workers Compensation Insurance (posting requirement)

5. W-4

  • To obtain a copy of the W-4 go to: www.irs.gov/pub/irs-pdf/fw4.pdf or contact your local Job Service Workforce Center
  • Have employee complete on first day of employment
  • Used to determine number of deductions or exemptions they will claim 
  • Will be used to determine amount of Federal and State Income tax withheld per paycheck

6. I-9 Proof of Authorization to work in the U.S. 

  • To obtain a copy of the I-9 go to: http://www.uscis.gov/i-9 or contact your local Job Service Workforce Center
  • Section 1. – Have employee complete on their first day of employment
  • Section 2. – Review, verify, and list the documents you have checked before signing form
  • Back of form has list of approved documents 

7. Montana New Hire Reporting Program

  • Can mail a copy of the W-4 to: MNHRP, Box 8013, Helena MT 59604-8013
  • Or fax to (1-888-272-1990) if outside the Helena area.  Helena employers can fax to 444-0745
  • Include employer name, address, and Federal Employer Identification Number.
  • Must be submitted within 20 days of employee start date.
